These Terms of Service ("Terms") govern your access to and use of the website www.signofpain.com (the "Site") and the purchase of products from SIGN OF PAIN, a brand operated by PAIN. LONDON LTD, a company registered in England and Wales (Company No. 16375531) with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("we", "us", "our"). By using the Site or placing an order, you agree to be bound by these Terms, together with our Return & Refund Policy, Shipping Policy, and Privacy Policy, which are incorporated by reference. If you do not agree, do not use the Site.

1. Eligibility

By using this Site, you represent that you are at least 18 years of age, or the age of majority in your jurisdiction, or are using the Site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

2. Products — Made to Order

All SIGN OF PAIN products are produced individually to order. Product descriptions, images, mockups, and specifications are provided for illustration; minor variations in color, print placement, and finish inherent to on-demand production do not constitute a defect. We make reasonable efforts to display products accurately, but we do not warrant that colors on your screen exactly match the physical product. We reserve the right to limit quantities, discontinue any product, or restrict sales to any person or region at any time.

3. Pricing

Prices are displayed in US Dollars (USD) and may change at any time without notice; changes do not affect orders already confirmed. Applicable taxes and shipping costs are shown at checkout. Prices do not include import duties or customs fees for international orders (see our Shipping Policy). In the event of a manifest pricing or listing error, we reserve the right to cancel affected orders and issue a full refund.

4. Orders & Contract Formation

Your order constitutes an offer to purchase. A binding contract is formed when we send you an order confirmation or dispatch the goods, whichever occurs first. We may refuse or cancel any order at our discretion, including for suspected fraud, pricing or stock errors, or violation of these Terms; in such cases any payment received will be refunded in full.

5. Cancellations by You

Because production begins shortly after purchase, orders can only be cancelled before they enter production. Contact us via the live chat on our website or at support@signofpain.com immediately after ordering if you wish to cancel. Once production or shipping has begun, the order cannot be cancelled. This does not affect any statutory withdrawal or cancellation rights described in our Return & Refund Policy.

6. Payment

Payment is due in full at the time of order and is processed by third-party payment providers. We do not collect or store full payment card details. You represent and warrant that you are authorized to use the payment method provided and that the billing information you supply is accurate.

7. Shipping, Risk & Title

Shipping terms, delivery estimates, customs responsibilities, and lost-package procedures are set out in our Shipping Policy. Unless mandatory law provides otherwise, risk of loss passes to you upon delivery to the address you provided. For consumers in the UK and EU, risk passes when you, or a person designated by you other than the carrier, acquires physical possession of the goods. Title passes upon receipt of full payment.

8. Returns & Refunds

Returns, refund claims, evidence requirements, and statutory cancellation rights are governed exclusively by our Return & Refund Policy. In summary: products are made to order and all sales are final, except for manufacturing defects, transit damage, or incorrect items, and except where mandatory consumer law (including the UK Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, or equivalent laws of your country of residence) provides otherwise.

9. Intellectual Property

All content on the Site — including all designs, artwork, graphics, logos, the brand name "SIGN OF PAIN", text, images, video, audio, and site code — is owned by or licensed to PAIN. LONDON LTD and is protected by copyright, trademark, and other intellectual property laws worldwide. No content may be copied, reproduced, modified, distributed, publicly displayed, or used for any commercial purpose without our prior written consent. Purchasing a product grants you ownership of the physical item only and does not transfer any intellectual property rights in its design. Unauthorized reproduction of our designs, including for resale or print-on-demand, will be pursued to the fullest extent of the law.

10. User Content

If you submit content to us or tag us on social media (photos, videos, reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for marketing and promotional purposes, unless you tell us otherwise in writing at support@signofpain.com. You represent that you own or have rights to any content you submit.

11. Acceptable Use

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site, its servers, or connected systems; (c) interfere with or disrupt the Site's operation; (d) scrape, harvest, or systematically copy Site content or data; (e) place fraudulent orders or submit fraudulent claims; or (f) use the Site to transmit malware or harmful code.

12. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties regarding the operation of the Site and its content, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This section does not affect statutory warranties and consumer rights that apply to purchased goods and cannot be excluded under applicable law, including under the Consumer Rights Act 2015.

13. Limitation of Liability

To the maximum extent permitted by applicable law, PAIN. LONDON LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Site or products. Our total aggregate liability for any claim arising from a purchase shall not exceed the amount you paid for the product(s) giving rise to the claim. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law, including non-waivable consumer rights.

14. Indemnification

You agree to indemnify and hold harmless PAIN. LONDON LTD, its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

15. Privacy

Our collection and use of personal information is described in our Privacy Policy.

16. Governing Law & Disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles, and the courts of England and Wales shall have non-exclusive jurisdiction. If you are a consumer, you additionally benefit from any mandatory provisions of the law of your country of residence, and nothing in this clause deprives you of the protection of such provisions or of the right to bring proceedings before your local courts where the law so provides. Before initiating any formal dispute, you agree to first contact us at support@signofpain.com to seek an amicable resolution.

17. Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, war, strikes, carrier disruptions, pandemics, or governmental actions.

18. Severability, Waiver & Assignment

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these Terms without our written consent; we may assign our rights in connection with a business transfer.

19. Changes to These Terms

We may update these Terms at any time. The version in force at the time you place an order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
